We are On the Fly Vacations, and Whiskey, Wine, and Dine Tours and are excited to help you with your travel. The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we," "us," "our" "OTFV," and "WWDT" refer to On the Fly Vacations and/or Whiskey, Wine and Dine Tours, and the terms "I" and "you" refers to the individual who signs this Agreement.

I understand that OTFV and WWDT are not the source or supplier of the travel services I have requested and act solely as agents for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are responsible for providing the travel services I have purchased. I consent to and request the use of those suppliers and agree not to hold OTFV and WWDT responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any injury, damage, delay or inconvenience.

I accept that OTFV and WWDT are not responsible for, nor will I attempt to hold them liable for, any injury, damage, or loss I may suffer on account of any conditions, actions, or omissions that are beyond its reasonable control. I understand that OTFV and WWDT is not responsible or liable for any conditions or appearance not disclosed by the supplier or not equivalent to the supplier's marketing and advertising.

I further understand and acknowledge that travel to many parts of the world may involve the risk of various hazards to my health and/or safety, including but not limited to disease, crime, terrorism, and warfare. Because each traveler's risk tolerance is different, OTFV and WWDT are not in a position to advise me whether I should travel to any particular place at any particular time. Instead, to assist me in making an informed decision, I should refer to objective third-party sources of travel information, such as that maintained by the U.S. Department of State (travel.state.gov).   I further understand OTFV and WWDT is not responsible or liable for any injury or accidents I incur during my travels.

I will review my travel documents for accuracy upon receipt and understand that I may contact OTFV and WWDT if I have any questions. I understand that discounted fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money.

I have been advised to use a credit card as this may offer me the opportunity to dispute the charge should a vendor cease operating.

I understand that the Transportation Security Administration (TSA) requires me to carry a government-issued identification card to board a flight. I have been advised that the name, date of birth, and gender that appears on the identification card must exactly match the same data that is listed on my airline ticket and in my booking records. I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight. I further acknowledge that beginning on October 1, 2022, I must present a driver's license or another form of identification that complies with the requirements of the Federal Real ID Act (see www.dhs.gov/real-id for more information).

I understand that if traveling internationally, I must have a valid passport and depending upon my destination and nationality, I may need to obtain one or more visas. I understand that I am responsible to ensure my passport will be valid for at least six-months after the completion of my travels.

Note to Client: Passport and visa information may be obtained by contacting the Travel Agent Section of the U.S. State Department at 202.647.5225 or by visiting the State Department's Web site at travel.state.gov. Non-U.S. passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC's Web site at www.cdc.gov

I understand that the airline tickets, air tours or other products I am purchasing are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. I acknowledge that I may be charged additional sums by OTFV and WWDT to offset increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets or any combination thereof. I hereby consent to any post-purchase price increases and authorize OTFV and WWDT to charge my credit card for such additional amounts. I understand that unless a case of fraud, OTFV and WWDT is not responsible for any chargebacks from the supplier. I take full responsibility for all charges made through my approved credit card.

I understand that I may purchase travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

I understand that when traveling with a group, as the group leader, I acknowledge and sign this agreement on behalf of all group members in my party. 

Covid-19 Waiver

The 2019 Novel Coronavirus* (COVID-19 "Coronavirus") is a known and rapidly evolving pandemic affecting travel worldwide with continued spread and impacts expected. The client is fully aware of the current global Coronavirus COVID-19 virus outbreak, the current travel restrictions, and the inherent risks involved if choosing to travel. The client understands that it is their responsibility to check the latest travel information regarding this virus outbreak with the CDC. https://wwwnc.cdc.gov/travel/notices

Client understands that it is their responsibility to have travel insurance to ensure they have coverage for all medical needs and trip cancellation but understands that concerns or fear of travel is not a covered reason for cancellation relating to the Coronavirus/ Covid-19 and will be denied. The client holds On the Fly Vacations and Whiskey  Wine and Dine Tours harmless for his election not to purchase travel insurance or any denial of the claim by the travel insurer as it relates to Covid-19 or any other claim under the policy.

Travel insurance generally only covers unforeseen events. Most insurers classified COVID-19 as a 'known event' in late January 2020. Please note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. The client understands that the insurance policy terms bind them as it relates to Coronavirus/Covid-19.

 The client is aware of the travel warnings, travel restrictions, and rules and understands the risks, is accepting of these, and knows that On the Fly Vacations and Whiskey, Wine and Dine Tours holds the agency harmless for any travel restrictions, death, illness, cancellations by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider, financial loss, quarantining rules or measures put in place at airports or destinations you are traveling through.

The client further agrees to hold On the Fly Vacations and Whiskey, Wine and Dine Tours harmless for any financial penalties or fees imposed by the suppliers, hotels, airlines, cruise lines, tour agencies, or any other travel provider due to cancellations or postponements due to Covid 19 and agrees not to institute a credit card dispute or "charge back" to On the Fly Vacations and Whiskey, Wine and Dine Tours for said penalties or fees. The client is aware that additional screening procedures and restrictions may occur at airports and in public areas.

The client is aware that these restrictions may include mandatory face coverings and temperature checks in airports, hotels, cruise ships, trains, or other means of transport. The client is aware that Immigration restrictions may be put in place before or during your travels that may impede your ability to enter or exit your destination as planned.

 The client is aware that it is their personal decision to travel and is doing so with full knowledge of current travel recommendations and travel restrictions regarding the Coronavirus COVID-19 and takes full responsibility for their actions.

The client understands and confirms that  On the Fly Vacations and Whiskey, Wine and Dine Tours, after reasonable inquiry, has provided the client with the best available information regarding pandemic protection policies offered by travel suppliers, including but not limited to airlines, hotels, cruises lines, tour agencies, transfer agencies or any other provider involved in clients booking, but that said suppliers may not enforce or apply said policies. Additionally, the client understands and is aware that even if said travel suppliers make a reasonable faith effort to enforce said pandemic policies and procedures, some travelers may refuse to cooperate with said policies.

The client further holds On the Fly Vacations and Whiskey, Wine, and Dine Tours harmless for any injury or harm. In consideration of the opportunity afforded to me and with full knowledge and acceptance of the risks associated with travel, I hereby release, indemnify, hold harmless, and covenant not to sue On the Fly Vacations and Whiskey, Wine and Dine Tours, its officers, employees, volunteers, agents, representatives, and any other person involved either directly or indirectly, from all claims, suits, expenses, attorney fees and demands of any nature (including negligence) caused by, deriving from, or associated with this trip.

I make these covenants, releases, and waivers knowingly and voluntarily. It is further understood and agreed that this Coronavirus/Covid 19 Waiver and Release of Liability, Assumption of Risk, and Indemnity Agreement is binding on my heirs and assigns.

 I sign it of my own free will. I hereby acknowledge that this Agreement will be binding by my signature for all travelers listed under this booking.
